PLEASE READ THIS SECTION CAREFULLY. IT SIGNIFICANTLY AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
1. Mutual Agreement to Arbitrate. Any dispute arising out of or relating to these Terms or the Site shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.
2. Informal Resolution First (Required). Before initiating arbitration, you must first send Giggrabbers a written “Notice of Dispute” to support@giggrabbers.com. The Parties agree to attempt good-faith resolution for sixty (60) calendar days after the Notice is received.
3. Exceptions. Either Party may pursue in court: (a) claims within a small claims court’s jurisdiction; (b) emergency equitable relief; or (c) claims to protect intellectual property rights.
4. CLASS ACTION WAIVER. ALL CLAIMS SHALL BE BROUGHT IN AN INDIVIDUAL CAPACITY ONLY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE PROCEEDING.
5. Opt-Out Right. You may opt out of this arbitration agreement by sending written notice to support@giggrabbers.com with subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Terms.
6. Statute of Limitations. Any claim must be commenced within one (1) year of the date the claim accrued. Claims not filed within this period are permanently barred.
